1. Acceptance of Terms

Welcome to Sparta Taekwondo. By using our website (spartatkd.com), booking a trial class, enrolling as a student, or purchasing any product or service from us, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our website or services.

These Terms apply alongside our Privacy Policy and Liability Waiver.

2. Who We Are

Sparta Taekwondo LLC is a Kukkiwon-certified martial arts school operating at 2650 Shadelands Dr., Suite F, Walnut Creek, CA 94598. Contact: info@spartatkd.com · (925) 938-5300.

3. Enrollment & Membership

• Enrollment is open to students ages 4 and up across our Tiny Titans, Juniors, Adults, and Team Sparta programs.
• A parent or legal guardian must enroll any student under 18.
• Placement in Team Sparta requires a yellow belt or higher.
• We reserve the right to decline or terminate enrollment for conduct that endangers students or violates our code of conduct.

4. Tuition, Fees & Payments

• Automatic recurring payments: Most students pay monthly tuition through Clover recurring payments. By providing your payment card at enrollment, you authorize Sparta Taekwondo LLC to automatically charge your card each billing cycle until you cancel. Your enrollment will renew automatically on a month-to-month basis.
• Alternative payment methods: In-person card payments at our Clover terminal, cash, or Zelle (muy@spartatkd.com).
• Registration fee: A registration fee applies to Team Sparta (our competition program) at enrollment. Our other programs (Tiny Titans, Juniors, Adults) do not carry a registration fee.
• Pricing: All prices are in U.S. dollars and may change with at least 30 days’ notice to active members.
• Failed payments: You are responsible for keeping your payment method current. If a payment fails, you have a 30-day grace period to resolve it; after that, class access may be suspended until the account is brought current.

California Auto-Renewal Disclosure (Business & Professions Code §17600 et seq., as amended by AB 2863, effective July 2025): Your monthly tuition renews automatically at the then-current rate until you cancel. You may cancel at any time using the methods described in Section 5 below. We will honor all cancellation requests submitted through the methods listed.

Post-enrollment acknowledgment: After you enroll, we will provide a written confirmation of your membership terms, billing schedule, and cancellation instructions — by email or at check-in — in a form you can retain for your records. We retain your enrollment consent records for at least three years, or one year after your membership ends, whichever is longer, in accordance with California law.

5. Cancellation & Refund Policy

• Monthly tuition: You may cancel your subscription by any of the following easy methods: (1) emailing info@spartatkd.com, (2) calling (925) 938-5300, or (3) notifying our front desk in person. Please provide at least 30 days’ advance notice. Cancellation takes effect at the end of the billing cycle after notice is received. If you enrolled with a minimum commitment term, cancellation takes effect no earlier than the end of that term. Tuition already paid is non-refundable.
• Team Sparta registration fee: Non-refundable once enrollment is complete.
• Merchandise (gear & uniforms): Students are encouraged to try on gear before purchasing. Once gear has been used, no refunds or exchanges will be issued. Unused items in original condition may be exchanged at our discretion.
• Trial classes: Free trial classes carry no charge and no refund obligation.
• Missed classes: Tuition is not pro-rated for missed classes. Make-up classes may be offered at the instructor’s discretion.

6. Code of Conduct

Our training culture is built on the Five Tenets of Taekwondo — Courtesy, Integrity, Perseverance, Self-Control, and Indomitable Spirit. All students, parents, and visitors are expected to:

• Treat instructors, fellow students, and staff with respect
• Follow instructor directions during class for everyone’s safety
• Arrive on time and in proper uniform (dobok) where applicable
• Refrain from disruptive, harassing, or unsafe behavior

We reserve the right to dismiss any student or visitor who violates this code, with or without refund at our discretion.

7. Intellectual Property

All content on spartatkd.com — including logos, text, photos, videos, and instructional materials — is the property of Sparta Taekwondo or used with permission. You may not copy, redistribute, or use our content for commercial purposes without written consent. The Kukkiwon name and mark are used under Kukkiwon’s guidelines.

8. Photos & Video

We sometimes photograph or record classes, events, and testings for marketing and educational use (website, social media, competition promotion). By enrolling, you consent to your or your child’s image being used for these purposes. If you prefer to opt out, notify us in writing at info@spartatkd.com and we will honor that request.

9. Assumption of Risk

Taekwondo is a physical contact activity that carries inherent risks of injury. By enrolling or participating in any class, event, or trial, you acknowledge these risks. See our Liability Waiver for the full assumption-of-risk and release language. A separate physical waiver must be signed before the first class.

10. Limitation of Liability

To the fullest extent permitted by California law, Sparta Taekwondo, its owners, instructors, employees, and agents are not liable for any indirect, incidental, or consequential damages arising from your use of our website or participation in our programs, except where caused by our gross negligence or willful misconduct. Our total liability for any claim will not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Sparta Taekwondo harmless from any claim or demand arising out of your breach of these Terms, your use of our website or services, or your violation of any rights of another party.

12. Third-Party Links

Our website may link to third-party sites (e.g., Kukkiwon, social media, payment processors). We are not responsible for the content, accuracy, or practices of those sites. Use them at your own discretion.

13. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the most recent revision. Continued use of our website or services after changes constitutes acceptance of the updated Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Contra Costa County, California. You and Sparta Taekwondo each waive any objection to venue or jurisdiction in those courts.

15. Electronic Communications

By providing your email address or phone number, you consent to receive communications from us electronically — including class updates, schedule changes, billing notices, and (where you’ve opted in) promotional messages. You may opt out of promotional communications at any time; transactional messages tied to your active enrollment will continue.

16. Entire Agreement

These Terms, together with our Privacy Policy and Liability Waiver — plus any signed physical waiver or enrollment agreement — form the entire agreement between you and Sparta Taekwondo LLC regarding our services, and supersede any prior agreements or understandings.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while reflecting the parties’ original intent.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any provision is only effective if made in writing and signed by an authorized representative of Sparta Taekwondo.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
